The Power of Precedence

The judiciary of Pakistan should wake up. Their support for Nawaz Sharif has been a calamitous negation of justice.
Their silence at the storming of the Supreme Court has indeed set a benchmark for illegal behavior. Not punishing the Nawaz goons has set an unfortunate precedent, which is followed in law as precedents are.


In the absence of punishment itself the action is deemed innocent and legal and becomes the law. The Sharifs have encased this precedence principle, so the judicial actions under this law overturn the regular laws, and obey the law of principle of precedence to be followed and obeyed in the future. Many judges that are so highly qualified in their study of law find ingenious argument to favor this reasoning.


The higher judiciary follows the run of precedents, regardless of the fact that the law may in fact be broken by this obedience.
These anomalies with the accompanying dangers to the law itself is the greatest damage done by Nawaz Sharif.
This was buttressed by the wily Iftikhar Chaudhry who enshrined these views with seal of the Supreme Court of Pakistan.
This seal will make it impossible to undo these decisions worse, they shall become the basis for future judgements.
Backed by the various bar associations that will rush to defend a bad judgement, as it makes for a lucrative source of revenue. Iftikhar Chaudhry has indeed created a new source of income. Lawyers are historically the most crooked people in the world.


They make a livelihood from defending criminals. Scruples are not of importance. The client is their priority, not right or wrong. That is left to the judge. Iftikhar Chaundhary should be on trial and all judgments pronounced by him must be expunged as if they do not exist.


The hue and cry of the various bar associations is to be expected but his decisions must be removed in the larger interest for the laws of the country. Every incorrect decision is used to grant an opportunity to circumvent the law. The judiciary must abide by the spirit and intent of the laws in the original form as enshrined by those who drafted the constitution.
